GENERAL TERMS AND CONDITIONS OF SALE


These terms and conditions are valid exclusively between the company SAND S.R.L. Società Sportiva Dilettantistica, with registered office at Via Po’ 3 - 07020 Palau (OT), registered with the Sassari Companies Register under protocol no. 26661/2025 and VAT no. 02899260901, hereinafter referred to as ''KITEWILD'', and any person who makes online purchases on the website kitewild.com hereinafter referred to as the ''CUSTOMER''. These terms and conditions may be amended and the date of their publication on the website shall be deemed the date of entry into force

These terms and conditions govern purchases made on the website kitewild.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree 70/2003 on electronic commerce.


ARTICLE 1 - Subject of the contract

With these general terms and conditions of sale, KITEWILD sells and the CUSTOMER purchases remotely the tangible movable goods indicated and offered for sale on the website kitewild.com. The contract is concluded exclusively through the internet, by the CUSTOMER accessing the address kitewild.com and placing a purchase order according to the procedure provided by the website itself.

The customer undertakes to read these general terms and conditions of sale before confirming their order, in particular the pre-contractual information provided by KITEWILD, and to accept them by ticking the appropriate box.

In the order confirmation e-mail, the CUSTOMER will also receive the link to download and store a copy of these general terms and conditions of sale, as provided for by art. 51 paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.


ARTICLE 2 - Pre-contractual information for the consumer - art. 49 of Legislative Decree 206/2005

Before concluding the purchase contract, the CUSTOMER reviews the characteristics of the goods, which are illustrated in the individual product sheets at the time of selection by the CUSTOMER.

Before the conclusion of the purchase contract and before validating the order with “obligation to pay”, the CUSTOMER is informed about:

  • the total price of the goods including taxes, with details of shipping costs and any other costs;
  • payment methods;
  • the deadline by which KITEWILD undertakes to deliver the goods;
  • the conditions, terms and procedures for exercising the right of withdrawal (art. 6 of these terms and conditions), as well as the standard withdrawal form referred to in Annex I, Part B of Legislative Decree 21/2014;
  • information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal;
  • the existence of the legal guarantee of conformity for the purchased goods;
  • after-sales assistance conditions and commercial warranties provided by KITEWILD.

The CUSTOMER may at any time and, in any case, before the conclusion of the contract, obtain information relating to KITEWILD, including its geographical address, telephone and fax number, and e-mail address, which are also provided below:

ARTICLE 3 - Conclusion and effectiveness of the contract

The sales contract is considered concluded when KITEWILD sends the CUSTOMER an order confirmation e-mail. The e-mail contains the CUSTOMER's data and the order number, the price of the purchased goods, the shipping costs and the delivery address to which the goods will be sent, as well as the link to print and store a copy of these terms and conditions.

The CUSTOMER undertakes to verify the accuracy of the personal data contained therein and to promptly notify KITEWILD of any corrections.

KITEWILD undertakes to describe and present the items sold on the website in the best possible way.

Nevertheless, some errors, inaccuracies or small differences between the website and the actual product may occur. Furthermore, the photographs of the products presented on www.kitewild.com do not constitute a contractual element, as they are merely representative.

KITEWILD undertakes to deliver the goods within 30 days from the sending by KITEWILD of the order confirmation e-mail to the CUSTOMER.


ARTICLE 4 - Product availability

Product availability refers to the actual availability at the time the CUSTOMER places the order.

This availability must nevertheless be considered purely indicative because, due to the simultaneous presence of several users on the website, products may be sold to other CUSTOMERS before the order is confirmed.

Even after KITEWILD has sent the order confirmation e-mail, cases of partial or total unavailability of the goods may occur. In this event, the order will be automatically adjusted by removing the unavailable product and the CUSTOMER will be immediately informed by e-mail or telephone.

If the CUSTOMER requests cancellation of the order, thereby terminating the contract, KITEWILD will refund the amount paid within 10 days from the day on which KITEWILD became aware of the customer's decision to terminate the contract.


ARTICLE 5 - Payment methods

Each payment by the CUSTOMER may be made exclusively via PayPal, through the pay-by-link links sent by KITEWILD, by the credit cards indicated on the website kitewild.com or by bank transfer.

In the case of payment by credit card and through the pay-by-link links sent by KITEWILD, the actual charge of the order amount will take place only when the order is complete and ready for shipment.

In the case of payment by PayPal, the actual charge will take place when KITEWILD sends the order confirmation e-mail.

Payments may also be made using Loyalty Vouchers or gift vouchers.

Communications relating to payment and the data provided by the CUSTOMER at the time of payment take place over dedicated secure lines. The security of credit card payment is guaranteed through VBV (Verified by VISA) and SCM (Security Code Mastercard) certification.


ARTICLE 6 - Prices

All sales prices of the products indicated on the website kitewild.com are expressed in Euro and include VAT and, where applicable, the WEEE contribution.

Shipping costs are not included in the purchase price, but are indicated and calculated at the time of completion of the purchase process before payment is made.

The CUSTOMER accepts KITEWILD's right to change its prices at any time; however, the goods will be invoiced on the basis of the prices indicated on the website at the time the order is created and indicated in the confirmation e-mail sent by KITEWILD to the CUSTOMER.

In the event of an IT, manual, technical or any other kind of error that may result in a substantial change, not foreseen by KITEWILD, in the retail sale price, making it excessive or clearly negligible, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 10 days from the day of cancellation.


ARTICLE 7 - Right of withdrawal

In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products.

In the case of requests for termination of the contract received by KITEWILD after the 14th day from the date of receipt of the products by the CUSTOMER, the CUSTOMER will be entitled exclusively to replacement with another product of equal or higher value, subject to payment of the price difference, or to the issue of a purchase voucher that can be used within one year from its issue.

The CUSTOMER who intends to exercise the right of withdrawal must notify KITEWILD by means of an explicit declaration, which may be sent by registered letter with return receipt or by sending the following form by e-mail: Returns and Refunds Form, to the address shop@kitewild.com.

The CUSTOMER may also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or, alternatively, by sending the standard withdrawal form referred to in Annex I, Part B, Legislative Decree 21/2014 (not mandatory), the text of which is provided below:

I/We (*) hereby give notice that I/we (*) withdraw from my/our (*) sales contract for the following goods/services (*)

  • Ordered on (*)/received on (*)
  • Name of the consumer(s)
  • Address of the consumer(s)
  • Signature of the consumer(s) (only if this form is sent in paper format)
  • Date

(*) Delete as appropriate.

In the event of exercising the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day on which they notified KITEWILD of their wish to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.

The goods must be returned to one of the two addresses that will be indicated: The Spot Cafè - Via Per Campeggio Portopollo (at The Spot Cafè),- 07020 Palau (OT), or Viale Venezia 67 -31015 Conegliano (TV)

The direct costs of returning the products are borne by the CUSTOMER. The cost is estimated to be up to approximately 300.00 (three hundred/00) euros.

The goods must be returned in the exact same condition in which they were sent, intact, in the original packaging, with labels and tags intact and not removed from the item, complete in all parts (including packaging and any documentation and accessories: manuals, cables, etc.) and complete with the related tax documentation. Without prejudice to the right to verify compliance with the above, KITEWILD will refund the amount of the products subject to withdrawal within a maximum period of 10 days, excluding the shipping costs for returning the goods.

As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, KITEWILD may suspend the refund until the goods have been received.

KITEWILD will make the refund using the same payment method chosen by the CUSTOMER at the time of purchase. In the case of payment made by bank transfer, and if the CUSTOMER intends to exercise their right of withdrawal, they must provide KITEWILD with the bank details: IBAN, SWIFT and BIC necessary for KITEWILD to make the refund.

In the event of withdrawal for a purchase made with a gift card or loyalty voucher, the amount will be returned to the CUSTOMER by means of a purchase voucher identified by a promotional code that will be sent to the CUSTOMER's e-mail address.

The purchase voucher will be valid for 1 year and may be used by the CUSTOMER for subsequent purchases in a single transaction.

WARNING: The cases set out in Article 10 of these Terms and Conditions are excluded from the right of withdrawal.


ARTICLE 8 - Legal guarantee of conformity

Every product distributed by KITEWILD benefits from the Manufacturer's Official Warranty under the terms indicated by Italian Law and is valid for products purchased and used within the territory of the European Community.

From the date of delivery of the product, the purchaser is covered by a warranty period of 24 months if they purchased the product for personal use, or 12 months if they purchased it for professional purposes (purchase with VAT number).

In the event of receipt of products that do not conform to the orders or are defective, the CUSTOMER has the right to have the conformity of the product restored free of charge by repairing or replacing the product itself. The CUSTOMER may exercise this right if the defect appears within two years from delivery of the goods and if the defect is reported to KITEWILD within two months of its discovery.

Subsequently, the customer must complete the Returns and Refunds Form and send it to shop@kitewild.com.

KITEWILD, in the event of a defective or non-conforming product, will arrange, at its own expense, for the product to be collected, compatibly with the CUSTOMER's availability.

The warranty never covers damage to products caused by improper use, nor any damage caused by the products themselves to third parties or to third-party property and objects.


ARTICLE 9 - Commercial warranty

All products presented on the website kitewild.com benefit, in addition to the legal guarantee of conformity referred to in the previous article, from a commercial warranty whose duration is stated on the product sheets of the items.

To benefit from warranty assistance, the CUSTOMER must keep the sales invoice regularly received by e-mail.


ARTICLE 10 - Delivery methods

The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order within and no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation e-mail sent by KITEWILD.

For each order placed on the website kitewild.com, KITEWILD issues an invoice for the shipped goods. The sales invoice will be sent to the CUSTOMER by e-mail. After the invoice has been issued, no changes may be made to the data indicated therein.

If a customer wishes to receive a tax invoice for their company, they must register on the website kitewild.com using the specific form called COMPANIES WITH VAT NUMBER.

KITEWILD will make sales to CUSTOMERS throughout Italy and Europe. Likewise, sales and shipments will NOT be made

outside the European territory.

Sales and shipments are NOT made to SWITZERLAND.


Pick-up at Pick Up points

Customers may collect products at one of the KITEWILD pick-up points upon request. After the order, the products will be sent to the chosen pick-up point and customers will be notified of the availability of the products for collection.

It is the customers' responsibility to collect the goods within 10 days from the notification of product availability for collection.

WARNING: In the case of requests to collect rigid SUP boards at one of the KITEWILD Pick Up points, from the moment of the order customers will no longer be able to withdraw from their purchase; the product will immediately become their property and they must collect it within 5 days from the notification of availability at the Pick Up point they have chosen.

Article 7 of our Terms and Conditions does not apply to these specific cases; therefore, no refunds or cancellations are provided.


ARTICLE 11 - Liability

KITEWILD assumes no liability for disruptions attributable to force majeure or unforeseeable circumstances, including those dependent on malfunctions and disruptions of the internet network, if it is unable to execute the order within the timeframes provided for in the contract.


ARTICLE 12 - Website access

The CUSTOMER has the right to access the website for browsing and making purchases. No other use, in particular commercial use, of the website or its content is permitted. The integrity of the elements of this website, whether audio or visual, and the related technology used remain the property of KITEWILD and are protected by intellectual property rights.


ARTICLE 13 - Cookies

The website kitewild.com uses ''cookies''. Cookies are electronic files that record information relating to the CUSTOMER's browsing of the website (pages viewed, date and time of viewing, etc.) and allow KITEWILD to offer a personalized service to its customers.

KITEWILD informs the Customer of the possibility of disabling the creation of such files by accessing their internet configuration menu. It is understood that this will prevent the Customer from making online purchases.


ARTICLE 14 - Entire agreement

These General Terms and Conditions of Sale consist of all the clauses that make them up. If one or more provisions of these General Terms and Conditions of Sale is deemed invalid or declared as such pursuant to the law, regulations or following a decision by a court having jurisdiction, the other provisions shall continue to have full force and effect.


ARTICLE 15 - Applicable law and competent court

These General Terms and Conditions of Sale are governed by Italian law.

Any dispute that cannot be settled amicably shall be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER, if located within the territory of the State.

In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010 for the resolution of any disputes arising in the interpretation and execution of these terms and conditions of sale.
